End User License Agreement

This End User License Agreement ("EULA") governs your use of the GEXRadar software platform, the TradingView browser extension, the GEXRadar indicator packages for NinjaTrader 8, ATAS, MotiveWave, Sierra Chart, and Quantower, and any associated software tools (collectively, the "Software") provided by GEXRadar LLC ("GEXRadar"). By installing, accessing, or using the Software, you agree to be bound by this EULA and by our Extensions & Indicators Terms, which supplements this EULA with respect to the extensions and indicator packages. If you do not agree, do not install or use the Software.

1. License Grant

Subject to your compliance with this EULA and the maintenance of an active, paid GEXRadar subscription, GEXRadar grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software solely for your own personal, non-commercial, informational purposes.

2. Restrictions

You may not:

• Copy, reproduce, modify, adapt, translate, or create derivative works of the Software
• Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of the Software
• Distribute, sell, sublicense, rent, lease, or otherwise transfer the Software or your license rights to any third party
• Use the Software to develop, train, or improve any competing product or service
• Remove, alter, or obscure any copyright notices, trademarks, or other proprietary markings within the Software
• Use the Software in any automated, scripted, or non-human manner to extract data without express written consent from GEXRadar
• Use any component of the Software to scrape, harvest, cache, or redistribute GEXRadar market data or analytics outputs
• Circumvent, disable, or defeat any license-key validation, code obfuscation, or other technological protection measure in the Software — these are technological measures within the meaning of 17 U.S.C. § 1201, and their circumvention is prohibited
• Republish, rebrand, white-label, or make the Software — or any substantially similar derivative of it — available under another name or through another website, marketplace listing, or browser-extension store

3. Ownership

The Software and all copies thereof are proprietary to GEXRadar LLC and title thereto remains in GEXRadar at all times. "Software" includes, without limitation: the GEXRadar TradingView browser extension and Pine Script indicator; the GEXRadar indicator packages for NinjaTrader 8, MotiveWave, ATAS, Sierra Chart, and Quantower; the GEXRadar web platform, dashboards, and charting interfaces; and all associated source code, object code, algorithms, models, level-derivation logic, visual designs, color schemes, look and feel, and documentation. All of the foregoing are original works of authorship protected by United States and international copyright law (© 2026 GEXRadar LLC — all rights reserved), and GEXRADAR and the GEXRadar logo are trademarks of GEXRadar LLC. All rights not specifically granted herein are reserved to GEXRadar. No title to or ownership of any intellectual property in the Software is transferred to you under this EULA.

Copying the Software's code, visual output, level logic, or distinctive presentation — in whole or in part, with or without modification, including by reimplementing it so as to be substantially similar — constitutes copyright infringement and unfair competition. GEXRadar actively monitors for infringing copies and clones and will pursue all available remedies, including DMCA takedown notices to hosting providers, browser-extension stores, and marketplaces; claims under 17 U.S.C. § 1201 for circumvention of license keys or obfuscation; injunctive relief; and recovery of damages and attorneys' fees where available. 4. Updates and Changes

GEXRadar may release updates, patches, or new versions of the Software at any time. This EULA applies to all current and future versions and updates. GEXRadar reserves the right to discontinue, modify, or remove any feature of the Software at any time without liability to you.

5. Termination

This license is effective until terminated. It will terminate automatically and immediately upon: (a) cancellation or expiration of your GEXRadar subscription; (b) termination of your account by GEXRadar for any reason; or (c) your breach of any provision of this EULA. Upon termination, you must immediately uninstall and cease all use of the Software.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. GEXRADAR EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GEXRADAR DOES NOT WARRANT THAT THE SOFTWARE WILL OPERATE WITHOUT ERROR, INTERRUPTION, OR DATA LOSS.

7. Limitation of Liability

IN NO EVENT SHALL GEXRADAR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOSS OF DATA, OR LOSS OF PROFITS, EVEN IF GEXRADAR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GEXRadar's total cumulative liability is further limited as set forth in Section 13 of the Terms of Service, which controls.

8. Governing Law

This EULA is governed by the laws of the State of Wyoming. Any disputes arising under this EULA shall be resolved in accordance with the dispute resolution provisions set forth in the GEXRadar Terms of Service.
