1. Information We Collect

1.1 Information You Provide

When you create an account, we collect your email address, display name (username), and a password. Passwords are stored using secure one-way hashing — we cannot view your raw password. You may update your display name at any time. Display names are not publicly visible to other users.

We do not directly collect or store your full payment card information. Payment data is processed and stored by our payment processors (Stripe and Whop) in accordance with their respective privacy policies and PCI-DSS compliance standards. We may see limited identifiers such as the last four digits of a card number for account identification purposes.

1.2 Usage Data

We may automatically collect technical data related to your use of the Service, including IP address, browser type, device information, and session activity. This data is used to operate, maintain, secure, and improve the Service.

1.3 Location Data

If you subscribe through Whop, Whop may collect general location data in accordance with their privacy policy. GEXRadar's native platform does not independently collect precise geolocation data.

1.4 The GEXRadar Extensions and Indicators

GEXRadar provides client-side tools that display your subscribed GEXRadar data on third-party charting and trading platforms: the GEXRadar browser extension for TradingView (including the associated userscript and Pine Script indicator), and the downloadable GEXRadar indicator packages for NinjaTrader 8, ATAS, MotiveWave, Sierra Chart, and Quantower (collectively, the "Extensions").

The Extensions are designed to minimize data handling. All gamma exposure (GEX) calculations and analytics are performed on GEXRadar's servers; the Extensions display data returned by the Service. To verify that you are an active subscriber and to deliver your data, the Extensions transmit your GEXRadar license key and associated authentication data to our servers. This transmission is strictly necessary for the Extensions' single purpose — authenticating your subscription and displaying your subscribed GEXRadar data — and to secure and maintain that functionality.

The Extensions do not collect, store, or transmit your browsing history, the contents of web pages you visit, keystrokes, personal communications, financial account credentials, or any personal data beyond the license key and authentication data described above. The Extensions do not sell or share data with advertisers or data brokers and do not track you across websites. The Extensions and the GEXRadar platform use cookies and local storage on your device to maintain session state, cache display settings and drawn levels, and deliver core functionality. 1.5 Search Console

GEXRadar uses Google Search Console to monitor aggregate search performance of our website. This tool does not collect personal user data directly and provides only aggregate traffic metrics.

2. How We Use Your Information

We use the information we collect to:

• Create and manage your account
• Process subscription payments and manage billing
• Communicate with you about your account, service updates, and support requests
• Detect and prevent fraud, abuse, and unauthorized access
• Enforce our Terms of Service and other applicable policies
• Comply with legal obligations
• Improve, operate, and maintain the Service

3. Data Sharing and Disclosure

We do not sell, rent, or trade your personal information to any third party. We may share limited data only with:

• Payment processors (Stripe, Whop) solely for the purpose of processing payments
• Service providers who assist in operating the platform, subject to confidentiality obligations
• Law enforcement or regulatory authorities when required by applicable law or valid legal process
• Successor entities in the event of a merger, acquisition, or asset sale, with reasonable prior notice to you

4. Data Retention

We retain your account information for as long as your account is active or as needed to provide the Service. You may request deletion of your account and associated personal data by contacting [email protected]. Residual data may be retained for legal, compliance, fraud prevention, or dispute resolution purposes as required by applicable law.

5. Security

We implement commercially reasonable technical and organizational measures to protect your information against unauthorized access, disclosure, alteration, or destruction. Passwords are stored using secure hashing. Payment data is handled entirely by PCI-DSS compliant third-party processors. However, no system is completely secure, and we cannot guarantee absolute security of your data.

6. Data Breach Notification

In the event of a data breach that affects your personal information and poses a risk of harm, GEXRadar will notify affected users as required by applicable law. Notification will be made via the email address associated with your account within a reasonable timeframe. Where required by state or federal law, we will also notify relevant regulatory authorities. We will provide information about the nature of the breach, the data affected, and steps we are taking to address it.

7. International Users

The Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to and processed in the United States, which may have different data protection laws than your country of residence. By using the Service, you consent to this transfer and processing. Users from jurisdictions subject to OFAC sanctions are prohibited from using the Service as described in our Terms of Service.

8. Children's Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have inadvertently collected data from a person under 18, we will take prompt steps to delete such information. If you believe we may have collected information from a minor, please contact us immediately.

9. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, or request deletion of personal information we hold about you. To exercise any such rights, contact us at [email protected]. We will respond within a reasonable timeframe consistent with applicable law. We may need to verify your identity before processing your request.

10. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), provides you with additional rights regarding your personal information. Subject to certain exceptions, these include: the right to know what personal information we collect, use, and disclose about you; the right to request deletion of your personal information; the right to correct inaccurate personal information; and the right not to be discriminated against for exercising your rights.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We have not sold or shared personal information in the preceding twelve months, and we do not knowingly sell or share the personal information of individuals. The categories of personal information we collect, the purposes for which we use it, and the parties with whom we share it are described in Sections 1 through 3 of this Policy.

To exercise your California rights, contact us at [email protected]. You may designate an authorized agent to make a request on your behalf, subject to our verification of the agent's authority. We will not discriminate against you for exercising any of your CCPA rights.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When material changes are made, we will update the effective date and, where appropriate, notify you via email. If our data handling practices for the browser extension change, we will disclose the change and, where required by applicable app-store policies, notify you before the change takes effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised policy.
