Affiliate Program Terms

These Affiliate Program Terms and Conditions ("Affiliate Terms") govern participation in the GEXRadar Affiliate Program ("Program") operated by GEXRadar LLC. By applying to or participating in the Program, you ("Affiliate") agree to be bound by these Affiliate Terms, the GEXRadar Terms of Service, and all other applicable GEXRadar policies.

1. Program Overview

The GEXRadar Affiliate Program allows approved participants to earn commission by referring new paying subscribers to GEXRadar. Affiliates receive a unique tracking link and discount code to share with their audience. Commission is earned on each active, paying referral generated through your unique affiliate link, subject to these Affiliate Terms — including the six-month reset described in Section 4.

2. Application and Approval

Affiliate participation requires submission of an application through the affiliate page on gexradar.io. GEXRadar reserves the right to approve or reject any application at its sole and absolute discretion, with or without reason. Approval is not guaranteed. GEXRadar also reserves the right to revoke affiliate status at any time.

3. Commission Tiers

Commission rates are based on your number of active referrals at the time of each monthly payout calculation:

Starter — 10% MRR Commission

Requirement: 0 to 9 active referrals

Growth — 15% MRR Commission

Requirement: 10 to 25 active referrals

Partner — 20% MRR Commission

Requirement: 26 or more active referrals

• All Growth tier benefits
• Dedicated GEXRadar account manager
• Joint content creation and live sessions
• Revenue share escalation review
• Featured partner spotlight

"Active referral" means a subscriber who joined through your unique tracking link and holds a current, paid, non-refunded, non-disputed GEXRadar subscription at the time of payout calculation. Tier level is evaluated at the time of each monthly payout based on your active referral count at that moment. Tier changes take effect at the next payout cycle.

Commission is calculated on the Monthly Recurring Revenue (MRR) actually collected from your active referrals, after applying any discount (including the affiliate discount code described in Section 5) and net of any taxes or processing fees where applicable. In other words, commission is a percentage of the discounted amount the referred subscriber actually pays, not the undiscounted list price. For annual subscribers referred by you, commission is calculated on a monthly equivalent basis. Commission is recurring: subject to the six-month reset in Section 4, an active referral generates commission for each month that referral remains active.

4. Six-Month Reset of Tiers and Commissions

Each Affiliate's six-month cycle is tracked individually from that Affiliate's join or reset date; the reset is not applied on a single shared calendar date across all Affiliates. Your current cycle start date and reset date are shown in your affiliate dashboard.

5. Discount Codes

Each approved affiliate is assigned a unique discount code that provides referred users with 10% off their subscription at the time of signup. During holidays, promotional periods, or special campaigns, GEXRadar may, at its sole discretion, temporarily increase the discount amount associated with affiliate codes. Affiliates will be notified of any such changes in advance where practicable.

GEXRadar reserves the right to modify, pause, or discontinue any discount code at any time. Discount codes may not be stacked with other promotions unless explicitly permitted by GEXRadar.

Discount codes are for your audience's use only. Using your own discount code to purchase a GEXRadar subscription for yourself or a connected party constitutes self-referral and is strictly prohibited.

6. Tracking and Attribution

Conversions are tracked via your unique affiliate link using a 90-day cookie attribution window. A conversion is attributed to you if the referred user clicks your link and completes a paid subscription within 90 days of that click. GEXRadar's tracking system is the sole and final authority on conversion attribution.

Attribution disputes must be submitted in writing to [email protected] within 30 days of the applicable payout date. GEXRadar will investigate and respond within a reasonable timeframe, but its determination shall be final.

7. Payouts

Commissions are calculated monthly and paid via Stripe to the payout details on file in your affiliate account. A minimum balance of $25.00 USD must be accumulated before a payout is issued. Balances below this threshold will roll over to the following month.

GEXRadar reserves the right to withhold, delay, or reverse commission payments in cases of suspected fraud, policy violations, chargebacks attributable to your referrals, or pending attribution disputes. Corrected or reversed commissions will be reflected in your dashboard.

8. Taxes and Required Documentation

Affiliates are solely responsible for any taxes, levies, or reporting obligations applicable to commission income in their jurisdiction. GEXRadar is required to collect appropriate tax documentation before issuing payment. Prior to your first payout, you must provide a valid IRS Form W-9 (for U.S. persons) or the applicable Form W-8 (such as Form W-8BEN, for non-U.S. persons). GEXRadar may withhold payment, and may suspend participation, until valid documentation is received. Where required by law, GEXRadar will report commissions paid to U.S. Affiliates (for example, on IRS Form 1099-NEC where applicable) and may apply any withholding required by applicable law.

9. Required Disclosure of Paid Relationship (FTC)

You participate in the Program in exchange for compensation, which creates a "material connection" between you and GEXRadar. Whenever you promote, recommend, review, or link to GEXRadar — in any medium, including social media, video, streaming, websites, blogs, newsletters, forums, chat servers, and messaging — you must clearly and conspicuously disclose that you are a paid affiliate and that you may earn a commission. Your disclosure must:

• be easy to notice and understand, placed close to the recommendation or link, and not hidden behind a click, buried in a description, or obscured by other content;
• be present in each individual piece of promotional content, not only on a separate page; and
• comply with the U.S. Federal Trade Commission's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255) and any equivalent requirements in your jurisdiction.

Simple, plain-language disclosures (for example, clearly stating that a link is a paid affiliate link and that you earn a commission) are required. Failure to disclose as required is a material breach of these Affiliate Terms and may result in immediate termination and forfeiture of unpaid commissions under Section 10. GEXRadar may request that you correct or remove non-compliant content.

10. Prohibited Conduct

Affiliates may not:

• Use paid search advertising (including Google Ads, Meta Ads, or TikTok Ads) that directly targets GEXRadar brand terms (e.g., "GEXRadar," "gexradar.io") without prior written approval from GEXRadar
• Make false, misleading, or exaggerated claims about GEXRadar's platform, features, performance, or any aspect of the Service
• Represent GEXRadar data, analytics, or outputs as financial advice, trade signals, or investment recommendations
• Promote GEXRadar without the disclosure required by Section 9
• Self-refer by using your own affiliate link or discount code to create or benefit from a new subscription
• Refer users you know to be ineligible under GEXRadar's Terms of Service, including users from OFAC-sanctioned jurisdictions
• Engage in spam, unsolicited messaging, cold outreach, or any promotional activity that violates applicable law, including CAN-SPAM, GDPR, or CASL
• Use GEXRadar branding, trademarks, logos, or intellectual property in any manner not expressly authorized in writing
• Offer cashback, rebates, or any portion of your commission to referred users as an incentive
• Create fake reviews, testimonials, or endorsements regarding GEXRadar

Violation of any prohibited conduct provision may result in immediate termination of affiliate status, forfeiture of all unpaid commissions, and potential legal action.

11. Compliance with Marketing Laws

You are solely responsible for ensuring that all of your promotional activity complies with all laws, rules, and regulations applicable to you and your audience, including without limitation the FTC Endorsement Guides, the CAN-SPAM Act, the General Data Protection Regulation (GDPR), Canada's Anti-Spam Legislation (CASL), and any applicable advertising, consumer-protection, privacy, and anti-spam laws. You are responsible for obtaining any consents required to contact or market to your audience. GEXRadar is not responsible for your promotional methods, and you agree to indemnify GEXRadar for claims arising from them as provided in the Terms of Service.

12. Modifications to Program

GEXRadar reserves the right to modify commission rates, tier thresholds, payout minimums, attribution windows, the six-month reset, program benefits, or any other aspect of the Affiliate Program at any time. Material changes will be communicated to active affiliates with reasonable advance notice via email. Continued participation in the Program after the effective date of any changes constitutes your acceptance of the modified terms.

13. Termination

GEXRadar may terminate your participation in the Program at any time, for any reason or no reason. You may also withdraw from the Program at any time by providing written notice to GEXRadar.

Upon termination, your tracking links and discount codes will be deactivated. Any commissions legitimately earned prior to the termination date — subject to verification, the minimum payout threshold, the six-month reset, and any applicable withholding — will be paid out within 60 days of termination. Commissions that would have been earned after the termination date are forfeited. GEXRadar reserves the right to withhold final payment pending resolution of any outstanding disputes or fraud investigations.

14. Relationship of Parties

Affiliates are independent contractors. Nothing in these Affiliate Terms creates or implies an employment, partnership, agency, joint venture, or franchise relationship between GEXRadar LLC and any Affiliate. Affiliates have no authority to bind GEXRadar contractually, make representations on GEXRadar's behalf, or incur any obligation in GEXRadar's name.

15. Marketing Materials and Trademark License

GEXRadar grants approved affiliates a limited, revocable, non-exclusive, non-transferable license to use the marketing materials and referral assets GEXRadar provides (including flyers generated in the affiliate dashboard) and the GEXRADAR name and logo solely to promote the Service as permitted by these Terms. Affiliates may not modify the marks, create their own GEXRadar-branded products or materials, register domain names, social-media handles, or advertising keywords confusingly similar to GEXRADAR, or state or imply that they are GEXRadar or that their content is published by GEXRadar. All goodwill arising from use of the marks inures solely to GEXRadar LLC. This license terminates automatically when your participation in the Program ends, after which all use of GEXRadar marks and materials must cease.

16. No Financial Advice

The Service and all GEXRadar data and analytics are provided for informational and educational purposes only and do not constitute financial, investment, or trading advice. As an Affiliate, you must not describe or present GEXRadar or its outputs as financial advice, trade signals, or investment recommendations, and you must not make performance or profit claims. Please review and comply with the GEXRadar Financial Disclaimer.

17. Governing Law

These Affiliate Terms are governed by the laws of the State of Wyoming. Any disputes arising under these Affiliate Terms shall be resolved in accordance with the dispute resolution provisions set forth in the GEXRadar Terms of Service.
