Extensions & Indicators Terms

These Extensions & Indicators Terms ("Extension Terms") govern your download, installation, and use of the GEXRadar browser extension and the GEXRadar indicator packages for third-party trading platforms (each, an "Extension," and collectively, the "Extensions"). These Extension Terms supplement, and are incorporated into, our Terms of Service and EULA. In the event of a conflict specific to the Extensions, these Extension Terms control. Capitalized terms not defined here have the meaning given in our Terms of Service.

1. The Extensions Covered

These Extension Terms apply to all GEXRadar client-side software that displays GEXRadar data on or within a third-party charting or trading platform, including:

• The GEXRadar browser extension for TradingView (including any associated userscript and Pine Script indicator), distributed through the Chrome Web Store and/or directly from gexradar.io;
• The GEXRadar indicator packages for NinjaTrader 8, ATAS, MotiveWave, Sierra Chart, and Quantower, distributed as downloadable files that you import into the applicable platform.

The Extensions are companion tools to the GEXRadar Service. They require an active GEXRadar subscription and a valid license key to function.

The GEXRadar TradingView browser extension and Pine Script indicator are included with every active GEXRadar subscription at no additional charge. Access to the downloadable indicator packages for NinjaTrader 8, ATAS, MotiveWave, Sierra Chart, and Quantower is provided as an optional add-on for an additional fee of $15.00 per month on top of your base subscription. All prices across the GEXRadar platform, including the add-on fee, are subject to change; changes will not affect your current billing period, and any price lock described in our Terms of Service applies only as expressly stated there.

2. License Grant and Scope

Subject to your compliance with these Extension Terms, the Terms of Service, and the EULA, and conditioned on an active subscription in good standing, GEXRadar grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the Extensions on devices you own or control, solely for your own individual use and solely to display GEXRadar data delivered to you through the Service.

This license does not grant you any right to, and you shall not, redistribute, resell, sublicense, lease, lend, publish, or otherwise make the Extensions available to any third party; share your license key or account access with any other person; or use the Extensions on behalf of any other person or entity. Each license key is issued to a single subscriber and is not transferable.

3. Data the Extensions Access and Transmit

The Extensions are designed to minimize data handling. All gamma exposure ("GEX") calculations, analytics, and data processing occur on GEXRadar's servers. The Extensions themselves do not perform this processing; they display data returned by the Service.

3.1 What the Extensions transmit

To verify that you are an active subscriber and to deliver your data, the Extensions transmit your GEXRadar license key (and associated authentication data) to GEXRadar's servers. This transmission is strictly necessary for the Extensions' single purpose — displaying your subscribed GEXRadar data — and to secure and maintain that functionality. Handling of any account data received is described in our Privacy Notice.

3.2 What the Extensions do not collect

The Extensions do not collect, store, or transmit your browsing history, the content of web pages you visit, keystrokes, personal communications, financial account credentials, or any personal data beyond what is described in Section 3.1. The Extensions do not sell or share your data with advertisers or data brokers, and do not track your activity across websites.

3.3 Local storage

The Extensions may use local storage or cookies on your device to maintain session state and to cache display settings and drawn levels for performance. This data remains on your device and is described further in our Cookie Policy.

4. Chrome Web Store Extension (TradingView)

The GEXRadar TradingView browser extension is distributed through the Google Chrome Web Store and is subject to the Chrome Web Store Program Policies in addition to these Extension Terms.

Single purpose. The single purpose of the browser extension is to authenticate your GEXRadar subscription and automatically plot and update your subscribed GEXRadar GEX levels on TradingView charts.

Permissions and disclosure. The extension requests only the permissions necessary for this single purpose. Any user data the extension collects, uses, or transmits is limited to what is strictly necessary for this purpose, consistent with Section 3. If our data handling practices change, we will update these Extension Terms and, where required, notify you before the change takes effect. You may uninstall the extension at any time through your browser's extension settings.

5. Downloaded Indicator Packages

The GEXRadar indicator packages for NinjaTrader 8, ATAS, MotiveWave, Sierra Chart, and Quantower are provided as downloadable files that you import into the applicable platform. In addition to the license restrictions in Section 2, you specifically agree that you will not:

• copy, mirror, re-host, or redistribute the downloaded files, in whole or in part, on any website, forum, repository, marketplace, chat server, or file-sharing service;
• decompile, disassemble, deobfuscate, or reverse engineer the files, except to the limited extent this restriction is prohibited by applicable law;
• remove, alter, or obscure any copyright notice, license key mechanism, watermark, attribution, or other proprietary marking contained in the files; or
• create derivative works from, or incorporate any portion of, the files into any other product or indicator.

Access to the downloadable files is tied to your subscription. We may fingerprint, watermark, or otherwise mark distributed files to identify the licensed subscriber, and unauthorized distribution may be traced to the originating account.

6. Intellectual Property and Ownership

The Extensions, including all source code, object code, compiled files, scripts, indicator logic, layouts, visual design, color schemes, icons, graphics, labels, animations, and the overall look and feel, together with all GEXRadar data displayed through them, are the exclusive property of GEXRadar LLC and are protected by United States and international copyright, trademark, trade dress, and trade secret laws. All rights not expressly granted to you in these Extension Terms are reserved by GEXRadar LLC.

No title to or ownership of any intellectual property in the Extensions is transferred to you. The GEXRADAR name and logo are trademarks of GEXRadar LLC. Nothing in these Extension Terms grants you any right to use them.

7. Prohibited Conduct and Anti-Copying

In addition to the restrictions above, you agree that you will not, and will not permit or assist any third party to:

• reproduce, imitate, or clone the Extensions or any substantial part of their source code, indicator logic, or proprietary output;
• copy or imitate the distinctive visual appearance, layout, styling, or presentation of the Extensions in a manner likely to cause confusion as to source, sponsorship, or affiliation;
• scrape, harvest, intercept, or reconstruct GEXRadar data or GEX calculations from the output of the Extensions for any purpose other than your own individual use;
• use the Extensions, or data obtained through them, to build, train, benchmark, or operate a competing product or service; or
• circumvent, disable, or interfere with any license key, authentication, rate-limiting, or security mechanism in the Extensions.

You acknowledge that the ideas and general functionality of a GEX overlay are not themselves claimed as proprietary, but that GEXRadar's specific implementation — its code, assets, distinctive design, and data — is proprietary and protected.

8. Enforcement of Our Rights

GEXRadar actively monitors for and enforces against unauthorized copying, redistribution, and impersonation. Remedies we may pursue include, without limitation: takedown notices under the Digital Millennium Copyright Act (DMCA) and equivalent laws; complaints to hosting providers, app stores, domain registrars, and platform operators; trademark and trade dress enforcement; and civil action for injunctive relief and damages, including statutory damages and attorneys' fees where available. You agree that unauthorized copying or redistribution of the Extensions would cause GEXRadar irreparable harm for which monetary damages alone would be inadequate, and that GEXRadar is entitled to seek injunctive relief without the requirement of posting a bond.

9. Third-Party Platforms

TradingView, NinjaTrader, ATAS, MotiveWave, Sierra Chart, Quantower, Google Chrome, and the Chrome Web Store are the products and trademarks of their respective owners. GEXRadar is not affiliated with, endorsed by, or sponsored by any of them. Your use of each platform is governed by that platform's own terms and policies, and you are responsible for complying with them. GEXRadar is not responsible for changes a platform may make that affect the availability or functionality of an Extension.

10. No Warranty; Financial Disclaimer

The Extensions are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. GEXRadar does not warrant that the Extensions will be uninterrupted, error-free, accurate, or compatible with any particular version of a third-party platform.

GEXRadar data and the Extensions are provided for informational and educational purposes only and do not constitute financial, investment, or trading advice. Trading involves substantial risk of loss. Please review our Financial Disclaimer in full.

11. Limitation of Liability

To the maximum extent permitted by law, GEXRadar LLC and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or trading losses, arising out of or relating to your use of or inability to use the Extensions, even if advised of the possibility of such damages. GEXRadar's total aggregate liability arising out of or relating to the Extensions will not exceed the amount you paid to GEXRadar for the Service in the twelve (12) months preceding the event giving rise to the claim. In the event of any conflict between this limitation and the limitation of liability in our Terms of Service, the Terms of Service control.

12. Termination

Your license to the Extensions terminates automatically if your subscription lapses or if you breach these Extension Terms, the Terms of Service, or the EULA. Upon termination, you must cease all use of the Extensions and delete or uninstall all copies in your possession, including any downloaded indicator packages. Sections 6 through 11, 14, and this sentence survive termination.

13. Changes to These Terms

We may update these Extension Terms from time to time. When material changes are made, we will update the effective date and, where appropriate or required, notify you by email or through the Service. Where the change affects data handling in the Chrome Web Store extension, we will provide notice before the change takes effect as required by applicable store policies. Your continued use of the Extensions after changes take effect constitutes your acceptance of the revised terms.

14. Governing Law and Dispute Resolution

These Extension Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Extensions is subject to the binding arbitration provisions, class-action waiver, and venue terms set forth in our Terms of Service, which are incorporated here by reference.
